Advertising Compliance Workshop

NJ CAR will be hosting a Seminar featuring Brad Miller, Esq., Director of Legal & Regulatory Affairs at NADA; Perry Pittenger, Esq., of Schiller, Pittenger & Galvin, P.C.; and Anthony Anastasio, Esq., NJ CAR’s Director of Legal & Regulatory Affairs on Tuesday, February 13, 2018 at the Holiday Inn in Clark (36 Valley Road, Clark, NJ 07066- Exit 135 off the Garden State Parkway).  The Seminar begins at 8:30 AM and ends at 12:30 PM and costs $129 per person (for Dealer Members).

The Seminar includes two sessions as follows:

Over the past few years, the Federal Trade Commission (FTC) has pursued hundreds of dealers nationwide for a variety of alleged unfair or deceptive advertising practices and levied hundreds of thousands of dollars in fines for non-compliance.  Brad Miller will review key federal advertising standards, and provide an overview of these recent federal actions, as well as a discussion of some of the steps dealers should take to avoid federal advertising pitfalls.

In 2016, the New Jersey Division of Consumer Affairs issued hundreds of citations and thousands of dollars in fines to New Jersey dealers for non-compliant Internet ads.  In addition, several dealerships were hit with $50,000 fines for “bait-and-switch” advertising for failing to include the cost of dealer-added equipment in their advertisements.  This Seminar will address New Jersey’s Motor Vehicle Advertising Regulations, federal regulation of lease and credit advertising by automobile dealers (Federal Truth In Lending Act, Regulation Z, and Regulation M), federal regulation of email and text message marketing (Telephone Consumer Protection Act, and CAN-SPAM Act) and the future trends in enforcement by federal and State regulatory agencies.  In addition, there will be a discussion about the defense of litigation and enforcement actions against New Jersey dealerships by regulatory authorities.

March 15, 16 & 20, 2018 In West Trenton

NJ CAR’s Dealership Compliance Training & Certification

NJ CAR is happy to announce the return of the Coalition’s Dealership Compliance Training & Certification Program to be held at NJ CAR Headquarters on March 15, 16 and 20, 2018.

The NJ CAR Program is the only one of its kind in the country that offers compliance training & certification for each management-level employee in the dealership including: Dealer Principals, General Managers, General Sales Manager, Controllers, Officer Managers, Chief Financial Officers, F&I Managers; Sales Managers, Parts Managers and Service Managers.  Depending on the size of the dealership (small, medium, large/mega), the training may involve anywhere from three to 15+ management employees.

The Coalition’s Compliance training and Certification program uses the NJ CAR Legal & Regulatory Compliance Guides for its course materials.  A special feature of this NJ CAR Program allows dealerships to obtain an NJ CAR Dealership Compliance Certification—including a plaque suitable for display purposes—by having all of their management-level employees trained, tested, and certified.

The following is an overview of the areas covered under the NJ CAR Program:

General Managers, General Sales Managers, Controllers, Office Managers and CFOs.  This one-day Training & Certification Seminar addresses relevant State and federal regulatory topics, including Consumer Protection/Consumer Fraud issues, lending and insurance laws, wage and hour laws, employment issues, the New Jersey Sales Tax, Domestic Security Fee, and Advertising Regulations, Tire Tax, Luxury & Fuel Inefficient Surcharge (LFIS), federal finance regulations, consumer privacy regulations, cash transaction reporting, and OFAC compliance.  The training will be held on Thursday, March 15, 2018 from 9 AM until 4 PM at NJ CAR Headquarters (856 River Road, Trenton, NJ 08628).  Participants who enroll in this session will receive copies of the NJ CAR Legal & Regulatory Compliance Guides at no additional charge (a $130 value).  The cost for this training and certification is $795 per person for Dealer Members.  Any dealership that has previously purchased the NJ CAR Legal & Regulatory Compliance Guides will receive a $100 credit (one credit for each set of Guides) to be applied towards the course fee for a General Manager, General Sales Manager, Office Manager, Controller, or CFO enrolled.

F&I Managers and Sales Managers.  This one-day Training & Certification Session will address:  State consumer protection/consumer fraud issues, advertising, promotions, New and Used Car Lemon Laws, finance and insurance laws, Retail Order Form issues, consumer privacy regulations, cash transaction reporting, OFAC compliance and more.  The training will be held on Friday, March 16, 2018, from 9 AM to 4 PM at NJ CAR Headquarters (856 River Road, Trenton, NJ 08628).  The cost for this training and certification is $595 per person for Dealer Members.  Seminar attendees will be provided with selected portions of the NJ CAR Legal & Regulatory Compliance Guides that are applicable to the course topics.

Parts & Services Managers.  This one-day Training & Certification Session will touch on: the New Jersey auto repair regulations, PIF and ERF licensing issues, body shop licensing (including new car dealer body shop sublet licensing issues), technician wage and hour issues, consumer privacy regulations, selected environmental compliance issues, Community Right-to-Know, Spill Act and OSHA.  Seminar attendees will be provided with selected portions of the NJ CAR Legal & Regulatory Compliance Guides applicable to the course topics.  The training will be held on Tuesday, March 20, 2018, from 9 AM to 4 PM at NJ CAR Headquarters (856 River Road, Trenton, NJ 08628).  The cost for this training and certification is $495 per person for Dealer Members.

NJ CAR also offers the option of on-site training for large and mega dealerships.
